These terms of business provide the basis for a contractual agreement between the service providers of available2work Ltd and any individual who uses the services of available2work Ltd.

(The boldface paragraph headings and defined terms are included for ease of reference only and have no binding effect) The defined terms in this terms of business are as follows:

“A2W” means available2work Ltd and it’s representatives

“Account” means the A2W account that you open by registering to use the A2W services

“Advertisers” means a person or legal entity that purchases advertising space on A2W to display advertising information

“Member” means a person or legal entity that registers with A2W services

“Client” means a member who uses the services of A2W to fill vacancies

“Work seeker” means a member who uses the services of A2W to find temporary or permanent work

“Temporary work” means work placements that are accepted on a short term and usually self employed basis

“Temporary worker” means a member who accepts work placements on a short term and usually self-employed basis

“Permanent work” means work that is accepted on a contract of employment

“Permanent candidate” means a member who is seeking a permanent contract of employment

“A2W Services” means any services that are provided by A2W

“User” means (1) a person who is a Member, using the Site on his or her own behalf, or (2) a person who is using the Site on behalf of a Member that is a company or  organization.

“Visitor” means a non-member who is visiting the Site

1. Copyright
1.1 All rights are reserved. All text and graphics are the copyright of A2W.
1.2 Copies of A2W text are permissible expressly for the purpose of using the services of A2W as a member.
1.3 Modification and publishing of A2W text and graphics is strictly forbidden without written consent of A2W representatives.
1.4 Documents provided on the resources page are for your personal use only. They may not be copied or passed on for further use. Users recommending documents on the resources page must direct people to the website for referral and use.

2. Screening and Vetting
2.1 A2W cannot verify the information provided on it’s site by its members, clients and advertisers. It is the responsibility of the user, members and clients to provide accurate information and verify any information that is relied upon for the purpose of using the A2W service. Providing information is subject to the policy.

3. Terms of purchase
3.1 By registering to use and using the services of A2W you accept the terms of business set in this document.
3.2 Clients are required to purchase a subscription for 1, 3 or 6 months at a time in order to fully use the services of A2W.
3.3 Clients may also choose to purchase job-posting space to assist with filing vacancies.
3.4 Clients will pay for A2W services by using the Payment Service, your card must be registered with 3D secure, if your card is not registered with 3D secure you will be invited to register at the time of purchase.
3.5 If payment fails the members’ membership may be terminated.
3.6 Advertisers purchasing a banner advertising space will be required to make payment with a valid credit/debit card as stated in 3.4 or will be invoiced.
3.7 Invoices will require payment within 14 days; failure to do so will incur costs of £2 per day that payment is overdue. Adverts will not be displayed until payment has been received.
3.8 Adverts will be displayed for 30 days per purchase.

4. Terms of engaging a temporary worker
4.1 The decision to engage a temporary worker through the A2W services rests entirely with the client.
4.2 Clients are not permitted to provide any contact details of temporary workers found on A2W to a third party. Clients are required to refer third parties to A2W.
4.3 A2W accepts no responsibility for verifying temporary workers working status, qualifications, training, CRB or suitability for the clients setting or vacancy.
4.4 All Temporary Workers use A2W as an introductory service as a self-employed professional. A2W accept no responsibility as an employer of temporary workers displayed on A2W.
4.5 As a client searching and engaging Temporary Workers you accept all responsibilities for ensuring that each Temporary Worker you book is suitable to work within your business or home.

5. Terms of contacting Permanent Candidates
5.1 The decision to contact a permanent candidate rests entirely with the client.
5.2 The decision to interview or employ a permanent candidate rests entirely with the client.
5.3 A2W accepts no responsibility for verifying permanent candidates working status, qualifications, training, CRB or suitability for the clients setting or vacancy.
5.4 As a client seeking Permanent Candidates you accept full responsibility for the suitability of candidates for employment.

6. Terms of registering for and seeking temporary work
6.1 Temporary Workers will be required to read and accept the current terms of business (including the privacy policy) when registering.
6.2 The A2W service is currently only available for individuals to gain work within England.
6.3 Only Temporary Workers with legal working status to work in England may register as a temporary worker.
6.4 A2W at no point accepts responsibility as an employer and serves only as an introduction service.
6.5 You agree to ensure that all information that you provide is honest and correct.

7. Terms for registering to display your CV for the purpose of seeking permanent work.
7.1 Permanent Candidates will be required to read and accept the current terms of business (including the privacy policy) when registering.
7.2 The A2W service is currently only available for individuals to gain work within England.
7.3 Only Permanent Candidates with legal working status to work in England may register for this service.
7.4 You agree to ensure that all information that you provide is honest and correct.

8. Partners and links
8.1 A2W may contain links to other websites. A2W accepts no responsibility or liability in respect of the operation or content of other websites linked to this website.

9. A2W Newsletters and updates
9.1 Clients, temporary workers, permanent candidates and advertisers may receive newsletters and updates sent to email addresses supplied when registering to use the services of A2W. If a client, temporary worker, permanent candidate and advertiser does not want to receive newsletters and updates they will be given the facility to opt out of receiving newsletters and updates.
9.2 Clients, temporary workers, permanent candidates and advertisers can also send an email to admin@available2work.co.uk to cancel receiving newsletters and updates.

10. Amendments
10.1 These terms of business may without notice be amended. At the point of registering and booking services you will be asked to read the terms and conditions. In addition to this please regularly check these terms for your information.
10.2 Members, clients or advertisers may not make or request changes to these terms.

11. Governing law
11.1 These terms and conditions and your use of the website are governed by English law and you submit to the exclusive jurisdiction of the English courts.

12. Warranties
12.1 A2W undertakes to answer any enquiries within 5 working days.

13. Liabilities
13.1 A2W accepts no responsibility in any way, under any circumstances for the suitability of vacant positions or applicants.
13.2 A2W does not guarantee the reliability or accuracy of the content provided on it’s site.
13.3 A2W does not guarantee that the specific requirements of the member or client will be met.
13.4 A2W accepts no responsibility for any interruption to A2W services, under any circumstances.
13.5 A2W will work to rectify any interruption to A2W services at the first opportunity.

14. Refunds
14.1 A2W does not offer refunds under any circumstances. If you believe you should receive a refund please use the complaints procedure as stated in 15.1. Please state your reasons in full.

15. Complaints
15.1 Any complaints should be made via the contact us section on the A2W website. A2W will endeavour to respond to the complaint within 7 working days.
